Dear potential tenant,

please don’t let this rather formal piece of writing put you off renting this property, please have patience and read it. We have had to incorporate it into the terms of the letting agreement / licence because, in the past, tenants have abused our good will and overcrowded their rooms to the point where we, as owners and fellow occupants of the property have not only had the resources of property stretched to the limit but risked prosecution. What is written below therefore is the reasons why these rules exist and their exact quantification.

This advert is for a room in a shared house and as such it is called a licence. It is different from an Assured Shorthold Tenancy. With an Assured Shorthold Tenancy you, the Tenant, are in charge of the property. If you overcrowd it, potentially breaking laws, YOU are legally and morally responsible. When you rent a room(s) in a shared house on a licence WE are legally and morally responsible. Furthermore our contract is with you as an individual to supply access to space and facilities in a house, you cannot delegate that right to anyone else. We understand that sometimes that may be difficult to understand, our rooms have lots of self contained facilities eg showers, toilets etc but they are rooms not independent properties.

What this means is that, although we call you Tenants, you are our (paying) guests. In theory that means that ANY guests that you invite are our guests and should be approved by us. Plainly this would be manifestly wrong as well as being completely impractical. We do not want to stop someone whose friend has popped round for a couple of hours in the afternoon for a chat and a cup of tea. However we do want to stop someone who has three other people move in with them on a permanent basis for three months. Unfortunately it has therefore become necessary to define exactly the limits of how long your guests can stay and what they can and cant do.

Reasons:
a) compliance with the governments "right to rent" policy. The government has introduced strict legislation relating to who is allowed to rent rooms / property. The landlord is responsible for enforcing this and can be prosecuted if they don’t.

b) health and safety issues - there are numerous protocols, articles and regulations that define the ideal amount of space it is optimum for a persons physical and mental wellbeing. It is not good, psychologically, for three people to be living permanently in one room, intended for one person. It can be both stressful and unhygienic.

c) "overuse" of resources - the room is let at an inclusive price which includes services either provided or paid for by the landlord, including heating, lighting, cleaning of common areas, water and waste disposal etc. Obviously more than one person using these items increases costs which have to be paid for by the landlord. Examples of this include: more people generate more rubbish, as the council only remove a certain amount each week this means trips to the recycling centre; toilets and waste pipes prone to blocking; extra use of electricity.

d) (Potential) conflict with other Tenants - the more people there are, the greater the likelihood of conflict with other (paying) Tenants. Example: complaints about increased noise.

e) Other people using the address as a “dead letter box” for fraud etc.

Rules:
a) The Tenant is one person and they are signatory to the agreement. All other people entering and using the property have the status of guests, no matter how long they stay.

b) Guests who take up permanent residence are trespassers.

c) Children count as guests no matter how young.

d) You must not have more than 5 people in the room at any time.

e) You must not have more than 1 other person (than yourself) stay overnight in the room for more than two nights in a seven day period.

f) You must not have more than 2 other people (than yourself) stay overnight in the room for more than one night in a seven day period. (It is envisaged that this would be exceptional circumstances (eg missed buses/trains etc).)

g) You must not have a separate set of keys cut for another person or persons

h) You must not accept mail in any other name apart from yourself

i) The Landlord reserves the right to forbid entry to specific guests without reason (this has never happened in my 25 years of letting).

If the Tenant is in any doubt about their use of the room they are advised to contact the Landlord for written confirmation that what they are proposing, falls within these rules.
Breach of any of the rules could lead to the tenant being given Notice to Vacate.

Viewing during the Coronavirus: in order to comply with government regulations we are unable to undertake our usual practice of "open house" views. We must do individual views at exactly the time agreed. We will send you a time to view, you then reply, sending your mobile number, you either agree or suggest a later time. We will then contact you between an hour and half an hour before the meeting to confirm it is happening.

If you decide you want to go ahead and rent the property you must pay a holding deposit of £100, this is deductible against the first months rent and holding deposit. This has the effect of removing the property from the market.
