Live Rent Free for a Year Prize Draw Terms

1. The Promoter

   1. The promoter is: Flatshare Limited t/a SpareRoom of Suite 2.06, Colony One Silk Street, Ancoats Urban Village, Manchester, M4 6AG ("SpareRoom").

2. The Prize Draw

   1. The title of the prize draw is "Live Rent Free for a Year".

3. How to Enter

   1. The Live Rent Free for a Year prize draw will run from 12:00 hours (midday) on Saturday 30 September 2023 (the "Opening Date") until 12:00 hours (midday) on Tuesday 31 October 2023 (the "Closing Date") inclusive.
   2. All prize draw entries must be received by SpareRoom by no later than 12:00 hours (midday) on the Closing Date.  All prize draw entries received after the Closing Date will not be counted for the prize draw.
   3. In order to enter the prize draw, you must:
      1. (to the extent that you do not already have one) register for a SpareRoom account, either via the website www.spareroom.co.uk or SpareRoom's mobile app;
      2. login to your SpareRoom account on the website www.spareroom.co.uk; and
      3. click on the "enter" button on the Live Rent Free prize draw entry page
      by the Closing Date.
   4. This prize draw is free to enter and no purchase is necessary to enter or win.  There is no charge to register for use of the SpareRoom platform or place a standard advertisement.  Upgrades are not required in order to enter this prize draw.
   5. Only one entry per person is permitted to the prize draw using the method set out in clause 3.3.  However, once you have entered the prize draw in accordance with clause 3.3, it is possible to obtain further entries to the prize draw in the following ways:
      1. for every friend you refer who enters this prize draw using the special personal referral link which is provided to you upon entry to the prize draw ("Referred Friend"), you will receive two (2) additional entries to the prize draw.  Each Referred Friend must be a unique individual, for example, not the same person with a different email address.  SpareRoom reserves the right to investigate friend referrals for fraud;
      2. for every friend of a Referred Friend that enters the prize draw, you will receive an additional entry to the prize draw;
      3. if you have entered a previous live rent free for a month prize draw or a previous live rent free for a year prize draw, you will receive an additional entry for each of these previous prize draws you have entered.  For example, if you have entered the live rent free for a month prize draw in August, September and October, you will get an additional three (3) entries to this prize draw;
      4. SpareRoom may offer additional opportunities for those that have already entered the prize draw in accordance with clause 3.3 to gain additional entries to this prize draw (for example publishing a code on Facebook which can be used to gain an additional entry) and the details and terms of such offers will be described within the offer itself.
   6. Use of any robotic, automatic, programmed or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification.  You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the rules.
   7. SpareRoom, its employees, affiliates, contractors, representatives, agents and legal advisers will not accept:
      1. responsibility or liability for prize draw entries that are incorrect, delayed, corrupted or not successfully completed, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      2. proof of transmission as proof of receipt of entry to the prize draw.
   8. By entering the prize draw, you are agreeing to be bound by these terms and conditions ("Official Terms and Conditions").

4. Eligibility

   1. The prize draw is open to all residents in the UK (England, Scotland, Wales and Northern Ireland) aged 18 years or over who are renting a room and/or property as of the Opening Date, except:
      1. employees of SpareRoom or its holding or subsidiary companies;
      2. employees of agents or suppliers of SpareRoom or its holding or subsidiary companies, who are professionally connected with the prize draw or its administration; or
      3. members of the immediate families or households of those that fall within clause 4.1(a) and clause 4.1(b) above.
   2. In entering the prize draw, you confirm that you are eligible to do so and eligible to claim the prize. SpareRoom may require you to provide proof that you are eligible to enter the prize draw.
   3. SpareRoom will not accept prize draw entries that do not comply with the Official Terms and Conditions of this prize draw.
   4. SpareRoom reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize draw.

5. The Prize

   1. There is a single prize for the prize draw.  The amount of the prize is calculated by taking the value, as set out in the latest SpareRoom Rental Index, of the average monthly rent for a double room (including bills) in your postal area e.g. SK1 and multiplying it by twelve (12).  This may mean that you win more or less than your actual yearly rent.
   2. The prize is not negotiable or transferable.
   3. In order to claim the prize you must provide to SpareRoom:
      1. proof of your residency, age and status as a renter, for example, a copy of your tenancy agreement or lodger agreement;
      2. an up to date, good quality photo of yourself, for use in connection with clause 9.2 and clause 9.3;
      3. a short paragraph explaining a little about yourself, your rental set-up and what you will do with the prize, for use in connection with clause 9.2 and clause 9.3; and
      4. details of a bank account to which SpareRoom can transfer the prize.

6. Winner

   1. A winner will be chosen, from all eligible entries received, by random draw performed by a computer process on or around Thursday 2 November 2023.
   2. The decision of SpareRoom regarding any aspect of this prize draw is final and binding.  No correspondence or discussion will be entered into about it.
   3. SpareRoom will contact the winner of this prize draw personally as soon as practicable but in any event within seven (7) days of the Closing Date, using the email address registered to the winner's account.
   4. SpareRoom must either publish or make available information that indicates that a valid award took place.  To comply with this obligation, SpareRoom will send the surname and county of the winner to anyone who emails press@spareroom.co.uk within one month of the Closing Date stated in clause 3.1.
   5. If you object to any or all of your surname or county being published or made available, please contact SpareRoom by emailing press@spareroom.co.uk.  In such circumstances, SpareRoom must still provide the information and winning entry to the Advertising Standards Authority on request.

7. Claiming the Prize

   1. If you are the winner of the prize draw, you will have seven (7) days from the date SpareRoom contact you in accordance with clause 6.3 to confirm acceptance of the prize and provide the detail required in clause 5.3. SpareRoom will then, within fourteen (14) days of receiving such satisfactory confirmation and detail, transfer the prize to the bank account details provided by you in accordance with clause 5.3(d). If you do not claim the prize or provide the details required in clause 5.3 in accordance with the timeframes set out in this clause, your claim will become invalid.
   2. SpareRoom will make all reasonable efforts to contact the winner in accordance with clause 6.3.  If the winner cannot be contacted or is not available, or has not claimed or is ineligible to claim their prize in accordance with clause 7.1, SpareRoom reserves the right to offer the prize to another entrant randomly selected in accordance with the process set out at clause 6.1 from those eligible entries that were received before the Closing Date.
   3. SpareRoom, its employees, affiliates, contractors, representatives, agents and legal advisers, will not be responsible or liable for a winner's failure to receive prize notifications or the prize due to the winner's spam, junk email or other security settings or for the winner's provision of incorrect or otherwise non-functioning contact or bank account information.
   4. SpareRoom shall not be responsible or liable for errors in the publishing of the offer, administration of the prize draw or announcement of the prize.

8. Limitation of Liability

   1. Insofar as is permitted by law, SpareRoom, and its agents, employees, affiliates, contractors, representatives and legal advisers will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, claim, expense (including legal fees), personal injury or death occurring as a result of or in connection with participation in this prize draw or acceptance, use or misuse of the prize except where it is caused by the negligence of SpareRoom, its agents or that of their employees.  Your statutory rights are not affected.

9. Consent

   1. By entering this prize draw, you consent to us contacting you by email in relation to this prize draw and other similar prize draws, including but not limited to in relation to details of winners, details of future prize draws and opportunities to increase the number of your prize draw entries.  You can withdraw your consent at any time by notifying us in writing, following any "unsubscribe" instructions included in any email which we send to you, or by clicking on "My Account" on the website homepage and updating your account preferences.
   2. You agree that SpareRoom may, but is not required to, utilise any information that you complete in the prize draw entry page regarding how you may spend the prize money if you were to win, on its website www.spareroom.co.uk and any other media, whether now known or invented in the future, in connection with any publicity of the prize draw (or similar prize draw).  SpareRoom confirms that it will not publish your name in connection with such information without your further express consent.  You agree to grant SpareRoom a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the prize draw entry, to use, display, publish, transmit, copy, edit, adapt, alter, store, re-format and sub-licence the prize draw entry for such purposes.
   3. If you are the winner of the prize draw, you consent, without further compensation, to taking part in such publicity as may reasonably be requested by SpareRoom for the purposes of promotion of the winner of this prize draw, and promoting further similar prize draws.  You agree to grant SpareRoom a non-exclusive, worldwide, irrevocable license, for the full period of any intellectual property rights in any material you provide to SpareRoom in connection with the Live Rent Free for a Year prize draw, to use, display, publish, transmit, copy, edit, adapt, alter, store, re-format and sub-licence the materials for such purposes.

10. Data Protection and Publicity

    1. SpareRoom will only process your personal information as set out in these Official Terms and Conditions and the SpareRoom Privacy Policy.  See also clause 9, clause 6.4 and clause 6.5, with regard to the announcement of winners.

11. General

    1. If there is any reason to believe that there has been a breach of these Official Terms and Conditions, including by acting fraudulently or dishonestly, SpareRoom, at its sole discretion, reserves the right to exclude you from participating in the prize draw or refuse to award the prize.
    2. SpareRoom reserves the right to hold void, suspend, cancel, amend, withdraw, terminate or temporarily suspend the prize draw where it becomes necessary to do so, including in the event of any error, unforeseen circumstances, suspected evidence of tampering with any portion of the prize draw or any technical reason outside its reasonable control, with no liability to any entrants or third parties, but will use all reasonable endeavours to avoid consumer disappointment.  In the event of termination, SpareRoom, in its sole discretion, may elect to select a winner from among all eligible entries to the prize draw received as of the date of termination.  In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the person whose details appear in the winner's registered account.
    3. These Official Terms and Conditions and the prize draw shall be governed by English law, and entrants to the prize draw submit to the exclusive jurisdiction of the courts of England and Wales.
    4. The invalidity or unenforceability of any provision of these Official Terms and Conditions shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Terms and Conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.   These Official Terms and Conditions cannot be modified or amended in any way except in writing by a duly authorised representative of SpareRoom.
